VI SOFTWARE TERMS OF SERVICE
Effective Date: January 1, 2025
1. General Provisions and Acceptance of Terms
1.1 Scope and Applicability
These Terms of Service (“Terms,” “Agreement”) constitute a legally binding contract between you, whether an individual or legal entity (“User,” “You”), and VI Software (“VI Software,” “we,” “our,” or “us”), governing your access to and use of all services, platforms, applications, software, websites, and any related resources provided by VI Software (collectively, the “Services”). By accessing, utilizing, or otherwise engaging with the Services, including but not limited to the creation, administration, or participation in modded Minecraft servers, you irrevocably acknowledge that you have read, understood, and agreed to be bound by these Terms in their entirety without modification. If you do not fully agree to these Terms, you are strictly prohibited from using the Services and must immediately discontinue any access or usage.
1.2 Legal Capacity and Authorization
By accepting these Terms, you represent and warrant that you possess the full legal capacity, authority, and rights to enter into this Agreement and to be bound thereby. If acting on behalf of a corporate or organizational entity, you warrant that you have the requisite authority to bind such entity.
2. Description of Services and Platform Overview
2.1 Provision of Platform Services
VI Software operates an integrated digital ecosystem enabling users to create, host, manage, and participate in modded Minecraft servers (“Servers”), utilizing both proprietary and third-party modifications, software extensions, and interactive features accessible via the VI Software launcher and associated applications. The Services are designed to facilitate seamless multiplayer interaction, server customization, and community engagement within the modded Minecraft ecosystem.
2.2 Modifications and Updates
VI Software reserves the exclusive right, at its sole discretion and without prior notice, to modify, suspend, discontinue, or restrict any aspect of the Services, including introducing new features, enhancements, subscription plans, advertising mechanisms, or other monetization tools, subject to compliance with applicable laws and regulations.
3. User Roles, Account Creation, and Security Obligations
3.1 User Roles
Users of the Services are classified as follows:
Licensees: Entities or individuals who create, configure, administer, or host Servers (“Server Creators”).
Players: Users who participate in gameplay or interaction on Servers without administrative privileges.
Contributors: Individuals providing content, code, or other contributions to the platform or community.
3.2 Account Registration
Users are required to register a valid account to access the Services. All registration information must be truthful, accurate, current, and complete. VI Software reserves the right to suspend or terminate accounts that contain fraudulent, inaccurate, or incomplete information or that otherwise violate these Terms.
3.3 Security and Confidentiality
You bear sole responsibility for maintaining the confidentiality and security of your account credentials, including passwords and authentication factors. Any activity conducted through your account is presumed authorized by you. You agree to promptly notify VI Software of any unauthorized use or security breaches. VI Software disclaims any liability arising from your failure to secure your account.
4. Platform License and User Obligations
4.1 License Grant to Licensees
VI Software hereby grants Licensees a revocable, non-exclusive, non-transferable, limited license to access and utilize the Services strictly for the purposes of establishing, operating, and managing modded Minecraft Servers. This license is contingent upon full compliance with these Terms and the separately governed Platform License Agreement (PLA), which sets forth additional operational and legal obligations specific to server governance.
4.2 License to Players
Players are granted a limited, revocable, non-exclusive license to access and interact with Servers hosted via the VI Software platform in accordance with these Terms and any applicable Server-specific rules.
5. User Conduct and Platform Usage Policies
5.1 Compliance with Laws and Regulations
All users agree to abide by all applicable national, supranational, and international laws, statutes, regulations, and treaties, including those related to data protection, intellectual property, and cybercrime.
5.2 Prohibited Conduct
Users shall not engage in any conduct or submit content that:
Is unlawful, fraudulent, or malicious.
Constitutes harassment, discrimination, defamation, or hate speech based on race, ethnicity, religion, gender, sexual orientation, disability, or any protected class.
Promotes violence, terrorism, or criminal activity.
Distributes malware, unauthorized modifications, cheats, hacks, or exploits designed to disrupt Services or gain unfair advantage.
Violates intellectual property or privacy rights of any third party.
5.3 Contributor Code of Conduct
Contributors must adhere to platform policies and maintain the integrity of mod development. In particular:
Contributors are prohibited from disabling, sabotaging, or interfering with core platform features, including but not limited to update delivery systems, telemetry, or platform services.
Any action taken to undermine VI Software’s operations or user experience through client-side or server-side code may result in permanent revocation of contributor status and liability under Section 10 (Indemnification).
5.4 Server Creator Responsibilities
Licensees who manage or operate servers must:
Not disable or block core platform functionalities, including update propagation or system communication endpoints, unless explicitly permitted by VI Software.
Avoid the use of automation tools, mods, or scripting that alter platform APIs or violate rate-limiting or platform messaging expectations.
Violations will result in immediate suspension of server licenses and may include legal action or enforcement under Section 11 (Termination and Suspension).
5.5 Malicious or Adversarial Behavior
Users, Licensees, or Contributors must not:
Use alternative account identities, obfuscation techniques, or technical interference to evade bans, monitoring, or platform detection.
Circumvent enforcement actions or logging systems implemented by VI Software or its authorized agents.
Offending accounts may be permanently terminated, and legal claims may be initiated in accordance with Section 12 (Governing Law and Dispute Resolution).
5.6 Reporting and Compliance Cooperation
All users are expected to act in good faith and must:
Promptly report any security vulnerabilities, exploitation methods, or TOS violations to VI Software through appropriate reporting channels.
Not exploit vulnerabilities for personal or third-party gain.
Users who fail to report known issues or attempt to profit from violations may be held jointly liable for any resulting damage and face consequences under Section 10 (Indemnification).
5.7 Content Moderation and Enforcement
VI Software reserves the right, but does not undertake the obligation, to monitor, moderate, remove, or restrict any User Content or behavior that violates these Terms or is otherwise objectionable or harmful.
6. Intellectual Property Rights and User Content License
6.1 User Content Ownership and License
Users retain ownership of their User Content but grant VI Software a perpetual, irrevocable, worldwide, royalty-free, sublicensable, transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and publicly display such content for the operation, promotion, and improvement of the platform.
6.2 Warranties and Representations
Users represent and warrant that they possess all necessary rights to grant the above license and that their User Content does not infringe on the rights of any third party.
7. Monetization and Commercial Use Restrictions
7.1 General Prohibition on Unauthorized Monetization
Monetization of any kind through the VI Software platform or its Services is strictly prohibited without prior explicit authorization and a valid commercial license issued by VI Software.
7.2 Prohibited Activities
Specifically, servers and users are prohibited from offering or facilitating any form of pay-to-win monetization, including but not limited to the sale of in-game items, privileges, or advantages, in strict compliance with Mojang’s End User License Agreement and related policies. Violation of these restrictions may result in immediate account suspension, termination, and potential legal action.
7.3 Authorized Monetization
Any permitted monetization activities must be conducted pursuant to formal agreements with VI Software and in full compliance with all applicable laws.
8. Security, Privacy, and Data Protection
8.1 Privacy Policy
VI Software’s collection, processing, and storage of personal data are governed by its Privacy Policy, incorporated herein by reference. Users acknowledge and consent to such practices.
8.2 Server Security
Licensees must ensure that their Servers are secured against unauthorized access and vulnerabilities. VI Software disclaims liability for any security breaches or data loss occurring on user-managed Servers.
9. Limitation of Liability, Disclaimers, and Force Majeure
9.1 Force Majeure Events
VI Software shall not be liable for any failure or delay in performing obligations under these Terms attributable to causes beyond its reasonable control, including but not limited to natural disasters, acts of war or terrorism, governmental actions, labor disputes, pandemics, or other unforeseeable circumstances (“Force Majeure Events”).
9.2 Exclusion of Liability
To the maximum extent permitted by applicable law, VI Software disclaims all warranties, express or implied, and shall not be liable for any direct, indirect, incidental, consequential, punitive, special, or exemplary damages arising from use or inability to use the Services, including loss of profits, data, or goodwill, regardless of legal theory or prior notice.
9.3 Third-Party Liability
VI Software explicitly disclaims any responsibility or liability for the acts, omissions, content, or conduct of any third parties, including Licensees, Players, contributors, or external service providers. Users engage with third parties at their own risk.
10. Indemnification
You hereby irrevocably undertake to indemnify, defend, and hold harmless VI Software, its affiliates, officers, directors, employees, agents, and licensors (collectively, the “Indemnified Parties”) from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses, including, without limitation, reasonable attorneys’ fees and legal costs (collectively, “Losses”), arising directly or indirectly out of or in connection with:
(a) Your use or misuse of the Services;
(b) Any breach or alleged breach by you of these Terms of Service or any applicable laws or regulations;
(c) Any infringement or alleged infringement of any intellectual property rights, proprietary rights, or other rights of third parties resulting from your content, actions, or omissions;
provided, however, that this indemnification obligation shall not extend to any Losses arising from the gross negligence, willful misconduct, or breach of applicable data protection laws (including, without limitation, the European Union General Data Protection Regulation (GDPR)) by VI Software or any of the Indemnified Parties.
This indemnity shall survive the termination or expiration of your access to or use of the Services.
11. Termination and Suspension
VI Software reserves the absolute right to suspend, restrict, or terminate any User’s access to the Services at any time for cause, including but not limited to breaches of these Terms, violations of law, or disruptive behavior, with or without prior notice.
12. Governing Law and Dispute Resolution
This Agreement shall be exclusively governed by and construed in accordance with the laws of the Kingdom of Spain, without regard to its conflict of law principles. The parties irrevocably consent to the exclusive jurisdiction and venue of the competent courts located within the Valencian Community, Kingdom of Spain, for the resolution of any disputes arising out of or in connection with this Agreement.
13. Miscellaneous Provisions
13.1 Severability
If any provision of these Terms is found to be invalid or unenforceable under applicable law, such provision shall be deemed modified or severed to the minimum extent necessary, and the remainder of the Terms shall remain in full force and effect.
13.2 Entire Agreement
These Terms, together with any referenced agreements and policies, constitute the entire agreement between you and VI Software regarding your use of the Services and supersede all prior communications.
13.3 Amendments
VI Software reserves the right to modify these Terms at any time by posting updated versions on the platform. Continued use after notice constitutes acceptance of such modifications.
