1. SCOPE AND CONSENT
This Privacy Policy (the "Policy") constitutes a binding legal agreement between the User and the Company. By installing, executing, or otherwise utilizing the Application. While the User may be subject to the VI Software Platform Privacy Policy the user provides their express and unequivocal consent to the processing of their Personal Data as described herein. This Policy is drafted in accordance with the General Data Protection Regulation (EU) 2016/679 (GDPR) and the Spanish Organic Law 3/2018 (LOPDGDD).
2. ARCHITECTURE OF DATA COLLECTION
The Application utilizes a centralized authentication architecture.
All credentials provided by the User are transmitted directly to the VI Software Authentication API.
The Company acts as the sole Data Controller for user credentials.
Passwords undergo one-way cryptographic hashing utilizing salted industry-standard algorithms prior to persistence in the Company’s databases.
3. CATEGORIZATION OF PROCESSED DATA
The Company processes data under the legal basis of Contractual Necessity (Art. 6.1.b GDPR) and Legitimate Interest (Art. 6.1.f GDPR).
3.1. Primary Identifying Information
Unique User ID (UUID), Discord Snowflake ID, associated email addresses, and account display names.
Bearer tokens and refresh tokens generated by the VI Software API and stored within the local client environment to maintain session persistence.
3.2. Technical and Telemetric Metadata
For the purposes of infrastructure integrity and anti-fraud measures, the Application collects:
Public-facing IPv4/IPv6 addresses, Hostnames, and ISP-related routing metadata.
Detailed system specifications including, but not limited to, CPU architecture, total volatile memory (RAM), operating system kernel version, and unique Installation/Hardware UUIDs.
4. DATA RETENTION AND ARCHIVAL PROTOCOLS
The Company observes a strict Data Minimization policy. Data is retained only for the duration necessary to satisfy the purposes of its collection:
Account-related PII is retained for the duration of the User's active account status.
IP addresses and hardware identifiers utilized in security events are retained for a period of 1,825 days to facilitate "Ban Evasion" prevention and to comply with statutory limitation periods for legal claims.
Automated crash logs and telemetry are purged after 90 days or upon the resolution of the identified technical instability.
5. DATA SUBJECT RIGHTS
Under the governing European framework, Users are granted the following irrevocable rights:
The right to receive a structured, machine-readable export of processed data.
The right to demand the permanent deletion of all Personal Data, subject to the Company’s statutory retention obligations for security purposes.
The right to limit how the Company utilizes data in the event of a dispute regarding data accuracy.
To exercise these rights, a formal request must be submitted to the Company’s Data Protection Liaison via contact (at) visoftware (dot) dev.
6. THIRD-PARTY DATA DISCLOSURE AND TRANSFER
The Company warrants that it shall not sell, lease, or distribute Personal Data to third-party commercial entities. Disclosure is restricted to:
Essential infrastructure providers (e.g., CDN services for modpack delivery) who are contractually bound to maintain equivalent data protection standards.
Disclosure to law enforcement or judicial authorities as required by a valid subpoena or court order under Spanish or EU law.
7. LIMITATION OF LIABILITY AND SECURITY
While the Company employs robust technical and organizational measures (including TLS 1.3 encryption for all data in transit), the User acknowledges that no electronic transmission is 100% secure.
The User is solely responsible for maintaining the confidentiality of their local session tokens and the security of the hardware upon which the Application is installed.
The User agrees to indemnify the Company against any data breaches arising from compromised User-side hardware or unauthorized access to the User’s local configuration files.
8. AMENDMENTS
The Company reserves the right to amend this Policy at its discretion. Continued use of the Application following the publication of an updated Policy constitutes an acceptance of the modified terms.
